# A BODACC alert names a customer: verify before continuing reminders

An alert names a customer while several payment reminders are waiting to be sent. The instinct may be to accelerate demands and obtain payment before other suppliers. This is exactly when the ordinary process needs reassessment. A notice concerning French insolvency proceedings can change how receivables should be handled and who needs the supporting documents.

First establish what the notice actually concerns. A similarly named company, an address change and filed annual accounts are not equivalent to an opening judgment affecting your debtor. Useful handling combines reliable identification, an examination of the event and prompt referral to the appropriate person. The alert starts that work; it is neither an automatic diagnosis nor a filed proof of claim.

## Read the notice before classifying the customer

BODACC publishes several kinds of information. DILA’s service description includes business sales, registrations, changes, proceedings and account filings. Notices originating from court registries can be read in HTML or downloaded as PDFs. A result in this bulletin therefore does not itself establish insolvency. [Service Public, BODACC access, checked 10 October 2025](https://entreprendre.service-public.gouv.fr/vosdroits/R20462).

Open the complete notice and record its identifier, the company, event, court and dates. Compare the business identifier with the contract and invoices. A trading name can change without creating a new legal entity; different companies can also operate under one brand.

Where details do not match, document the discrepancy and request verification. Do not attach the notice to every account sharing a word in its name. The approach for cases where [the payer differs from the customer](https://www.billabex.com/en/blog/payer-versus-customer-entity-mapping/) separates debtor, group and payment centre. A commercial connection between entities does not combine their proceedings.

This article concerns French procedures. An English-speaking finance team dealing with a French customer still needs the applicable French process examined. The language of the reminder does not determine the legal treatment of the claim.

## Preserve three different dates

The judgment, its publication and arrival of your alert email may have different dates. They answer different questions. Retrieve the legally relevant date from the documents rather than starting every calculation when someone opened the inbox.

In a simulation, a judgment is made on 12 October, published on 16 October and noticed in the monitoring inbox on 19 October. The three days between publication and reading measure an internal detection delay. They do not extend applicable legal deadlines. These invented dates concern no actual business.

DILA describes a free daily alert service, but technical receipt of an alert does not ensure anyone takes ownership. Assign a primary reviewer and cover who can inspect the bulletin, identify the account and flag missing information. An inbox monitored by one person on leave preserves the organisational risk the subscription was intended to reduce.

Keep the downloaded notice and its source together. A copied email subject gives the next reviewer too little information to distinguish an opening judgment from a later event in an existing procedure.

## Move affected claims out of ordinary handling

Article L622-7 of the French Commercial Code provides, among other matters, for restrictions on paying claims arising before the opening judgment, with exceptions and specific authorisations. It sits within the sauvegarde framework; its application to the procedure and claims concerned requires verification. It does not justify summarising every case as no payments being possible. [Commercial Code, article L622-7, version effective since October 2021](https://www.legifrance.gouv.fr/codes/article_lc/LEGIARTI000044052577/2026-05-07).

Operationally, stop unsuitable automated actions for the identified scope and obtain appropriate legal handling. This does not mean deleting invoices, recording a fictional receipt or abandoning the claim. Preserve the balance and the reason the process changed.

[Exceptions requiring human review](https://www.billabex.com/en/blog/ai-collections-agent-human-exceptions/) have a concrete purpose here: checking documents, classifying claims and deciding what follows. Someone needs to accept that handover. A notification with no owner can leave reminders paused while the claim itself receives no attention.

Avoid an account-wide instruction that hides which invoices were examined. Separate claim groups when their underlying events differ, and make any uncertainty visible to the person deciding the next action.

## Reconstruct the position requiring examination

Consider a fictional euro account. In its first group, the underlying services all predate the judgment. Two invoices total €12,000 and €8,000. A €5,000 payment was received and allocated before the judgment, and a valid €1,000 credit note also reduces the first invoice. The remaining amount to examine is €14,000: €12,000 plus €8,000 less €5,000 less €1,000.

A separate €3,000 invoice concerns a service performed after the judgment. Keep it in a distinct group for classification. Together the groups produce a €17,000 accounting balance, but that total does not establish identical legal treatment for all €17,000. The PDF’s issue date alone does not determine when each claim arose.

| Simulated item | Amount | Matter to document |
| ------------------------------- | ------: | ---------------------------------------------- |
| Invoices for earlier services | €20,000 | Supporting documents and claim origin |
| Earlier payment and credit note | −€6,000 | Allocation and evidence |
| Remaining first group | €14,000 | Treatment to confirm in the proceedings |
| Separate later service | €3,000 | Own classification, without automatic grouping |

The table prepares an assessment rather than replacing an approved filing. Explain differences between the collections system and accounting before supplying the figures. In particular, keep unallocated cash visible instead of arbitrarily deducting it from whichever account creates the most convenient total.

## Arrange the filing around a verified deadline

Service Public describes a general two-month period from publication of the opening judgment in BODACC, alongside particular starting points and extensions depending on the circumstances. It also identifies documents and recipients according to the procedure. Confirm the exact deadline and authorised filer for the case; two months is not automatically sixty days. [Service Public, declaring claims, checked 27 November 2024](https://entreprendre.service-public.gouv.fr/vosdroits/F22359).

Do not postpone preparation until the next monthly sales review. Assemble invoices, orders, evidence of performance, movements and known disagreements. The appropriate adviser or responsible person checks amounts, maturities, any security and the transmission route. A BODACC alert performs none of those tasks for them.

Retain evidence of transmission and establish what further monitoring is required. Prepared is different from submitted; submitted is different from admitted. Verification and challenges may follow. None of those stages should be renamed payment obtained on a collections dashboard.

An internally planned date should leave enough time for the responsible person to review the material. That organisational target supports the work but does not replace the actual procedural deadline or establish a universal filing timetable.

## Give each team a consistent instruction

Sales needs to know which decisions require examination before another order or promise to the customer. Accounting needs the documents and agreed classification. Collections needs the scope of paused messages, the procedure owner and the next review point.

Do not announce an assumed recovery percentage or complete loss from the judgment’s title alone. The [age of credit information](https://www.billabex.com/en/blog/outdated-credit-information-customer-review/) remains separate from this specific legal event. Update cash assumptions using available evidence rather than preserving an old promise as certain receipts.

When assessing [the Billabex agent](https://www.billabex.com/en/product/agent/), use this scenario to examine referral to human decision-making and retention of the account’s context. The aim is to prevent ordinary reminders based on an instruction that no longer fits, while the business’s rights continue to receive attention through the competent process.
